Terms & Conditions

Thank you for selecting Plant Solutions! The following terms and conditions are part of the agreement of work to be performed by Plant Solutions Tree & Lawn Care, LLC and with the information on the front, constitute the entire
agreement. This estimate is valid for 45 days.

WORK PERFORMED BY PLANT SOLUTIONS TREE & LAWN CARE, LLC.
Work crews will arrive at the job site unannounced unless otherwise noted herein. The schedules may vary due to weather, client schedule conflicts or insect, mite and disease cycles. Tree, Shrub and Lawn Health Care Programs are designed to manage and not eradicate insect, mite and disease infestations. Horticulturally tolerable levels of insects, mites and disease
may still be present after treatments. Major infestation will require additional services at additional cost to the client, pending client approval. Plant Solutions Tree & Lawn Care, LLC shall not be liable for any plant damage or losses due to animal damage, weather or causes beyond our control.

WORKMANSHIP
All work will be performed in a professional manner by experienced personnel outfitted with the appropriate tools and equipment to complete the job properly. Our work meets and exceeds the guidelines and standards set forth by ANSI (The American National Standards Institute) A300. The client is responsible for advising Plant Solutions Tree & Lawn Care, LLC regarding the location of underground utilities in the area where work is to be done.

Plant Solutions Tree & Lawn Care, LLC shall not be responsible for damage to such utilities unless the location has been indicated prior to the commencement of work. Any dispute, controversy or claim arising out of or relating to this agreement, shall be determined and settled by arbitration under the Rules of the American Arbitration Association. The arbitration award shall be final and binding. Judgment on the award may be entered in any Court having competent jurisdiction thereof. Recommendations are intended to minimize or reduce hazardous conditions associated with trees.
No guarantees are intended or implied with regard to work product.

UNDISCLOSED UTILITIES:
Plant Solutions Tree & Lawn Care LLC, employees and representatives will not be responsible for any undisclosed utilities including but not limited to: septic systems, dry wells, cesspools, storage tanks, irrigation systems. We assume no liability for lawn & driveway damage incurred by trucks and equipment on the property. All hazards and precautions will be fully stated in writing.

INSURANCE
Plant Solutions Tree & Lawn Care, LLC is insured for the liability resulting from injury to persons or negligent damage to property, and all its employees are covered by Workers Compensation Insurance. A certificate of insurance is available upon request. Plant Solutions Tree & Lawn Care is not responsible for any underground damages when deep root fertilizing.  Plant Solutions Tree & Lawn Care is not responsible for damages to irrigation pipes, electric lines, invisible dog fences and any underground item that is not natural.  It is the responsibility of client to mark out lines or irrigation heads and invisible dog fences.  Plant Solutions Tree & Lawn Care is not responsible for any unforeseen contingencies.

OWNERSHIP
The client warrants that all trees, plant material and property on which work is to be performed are either owned by the signatory to this agreement or that permission for the work has been obtained from the owner by the signatory. It is further agreed that the property owner or representative shall be responsible for obtaining any and all permits, which may be required by local authorities. Plant Solutions Tree & Lawn Care, LLC. is hereby held harmless from all claims for damages resulting from the client's failure to obtain such permits.

TERMS OF PAYMENT
All accounts are payable upon receipt of invoice. A service charge of 2.0% per month, which is an annual percentage rate of 18% will be added to accounts thirty days after the invoice date. Your next treatment may not be performed if your account is past due. Past due balances void any guarantees. If outside assistance is used to collect the account, the client
is responsible for all costs associated with the collection including, but not limited to reasonable attorney fees and court costs. 

CONCEALED CONTINGENCIES
Owner agrees to pay contractor on a time and material basis for any additional work required to complete the job occasioned by the concrete or other foreign matter; stinging insect nests in the tree, trees, or branches; rock, pipe, plants, irrigation line or electrical line encountered in excavations; and work not described on the front page of this agreement, or
any other condition not apparent in estimating the work specified.  

PRODUCT INFORMATION/SPECIFIC DATE PRE-NOTIFICATION
In respect to Plant Health Care, specific states require that product application information be provided to the client. Part of this agreement is our Datasheet, which provides approximate dates of application and ingredient information when required. Please note that you have the right to receive specific date pre-notification for certain applications. 

OUR UNCONDITIONAL GUARANTEE
Should our service fall short of your expectations, please contact us immediately. We use only premium quality fertilizer, grass seed, and workmanship. It is impossible to guarantee the growth of grass or have freedom from noxious weeds. The proper care of a newly seeded or sodded lawn is equally important as the original installation. To assure growth, it is
very important to keep the lawn moist until root growth is established. Consequently, grass will then choke out germinating weed seeds which are present in all soils. Seed work carries no guarantee. Final payment will be due only upon your complete satisfaction.

ALL LAWN CARE AND PLANT CARE PROGRAMS ARE CONTINUOUS YEAR AFTER YEAR.  YOU MUST SUBMIT A CANCELLATION LETTER BY MAIL TO CANCEL PROGRAMS.
